I?d like to say a word or two about this warrant-less wiretapping business. Not only to people who are reading this out of interest but also to the poor slob at the NSA who HAS to read it.

There is a lot of debate currently about wether or not the President in his mission to protect the American people has the right to order wiretaps without obtaining a court order. Much of the debate is way off the point.

On one side, you have the President and his crew arguing that ?In a time of war? the President has powers beyond the normal scope of the office... now.. set aside that ANY president could declare war on something like ?Terror? and make the case that we are now and will always be at war with said forces of evil and that in that instance the extra powers granted during this ongoing war are basically permanent.... and you still have The President arguing for authoritative powers. When you have a system in place like that... America ceases to be America. You have a military dictatorship. I hate to belabor a point but there are TWO ways of destroying something... be it a social, governmental or religious system or a building. one..you Physically destroy it, blow it up, burn it down, what have you..OR.. you change it into it?s opposite. When The Soviet Union was our greatest threat the very same people who support the current administration also vilified and opposed the Soviets..and for good reason. The Ironic thing is that the very same traits that they hated the Communists for, control of the media, torture and disappearances, the KGB and their constant spying on their own citizens... are the very same things they LIKE Bush and more to the point Cheney for. Maybe these cats secretly wanted the USSR to win. Or maybe they did win through infiltration. (cue Twilight Zone theme) If you had to pick a Russian Mole out of a line-up you?d probably say ?Number 2? and Richard Cheney would be asked to step forward.

Now on the other side you have people arguing about ?it?s bad to spy on American?s? in the most general sense. The problem with this argument is nobody really believes their government is spying on them. People want to believe that the government wants to help them...well...until they?re in line at the DMV. So the argument doesn?t land.

Here?s where I think the real fight is. It is not about wether the President has the right to become a dictator on a ?time of war? to protect the citizens of this country. Nor is it a matter of abstract general Big Brother-like behavior where Bush wants to crawl up everybody?s keister with a microscope. The President, without having to break the law, has the ability to tap phones and computers for 3 DAYS before he even has to ASK for a warrant. In the time since it?s creation, the FISA court, a top secret court who?s sole job is to approve warrants, has issued over 19,000 warrants. It has only turned down 4 requests. Those requests were re-worded and the warrant was granted! Every request ever made to the FISA court for a warrant was Granted. Every..Single..One.

Why would the president need to circumvent a top secret organization that is basically a rubber stamp for all his National Security Needs?

There can be only one reason.

He knew they would turn his requests down.

The only reason the FISA court would turn him down is if the requests were unnecessarily broad, contrary to national security, or unconstitutional. The Bush administration was caught spying on the UN in the lead up to the war. They were using info gathered from bugs in the UN building in NY to see how certain countries were going to vote so they could apply pressure. Bush is using the NSA, not to spy on terrorists or even average citizens, but to spy on his political and social opposition. That?s why he didn?t get a warrant. That?s why it?s illegal. That?s why it?s impeachable.

Richard Nixon did the same thing, Made the same excuse, And was impeached.
