i wrote a script based on a short story published in a magazine over 11 years ago. the magazine is no longer being published, who has the rights to the story?

I beleive the basic idea is that you have to acknowledge the prior source, this being the author, possibly the magazine as well. Contact the author of the article, through the national press association. However, if you film is loosely based on the article, you may only have to refer to the origional version. This all depends on whether the articles subject was in the public domain, like a news story as compared to a private family story.
