a man was caught committing a heinous crime of murder on monday. by friday he was taken to court. the judge says to the man:
'do you have anything to say in your defense before i give you my verdict?'
the man replies:
'your honor, there is no way i could have committed the crime you are accusing me of on monday because the universe was created five minutes ago.
when the universe was created, everything that seems to be 'the past' has been neatly arranged to give you the idea that there really was a past. all of your memories and experiences that you think you have right now were only constructed within that five minutes.
if you can prove to me that the universe wasn't created five minutes ago, i will gladly stand here and accept my punishment.'
you are the judge. what do you say?

My Shattie, metaphors is a game we both master. Are we to keep it going on, and soon all the other guys will play mute, and this I do not want. So I remain awaiting your own thoughts concerning the issue in question.

If that is his alibi, it is up to him to put forward some evidence for it, not just say it's unfalsifiable and therefore must be true (an argument that doesn't work at all). If, for example, his alibi was that he was somewhere else, he'd have to produce some kind of proof that he was elsewhere - not insist that the judge would have to prove he wasn't there.
