Willie is talking about this, and just had someone from Florida on the phone. Apparently, this woman is looking at the possibility of life without parole.
Apparently Florida doesn't have a statutory rape charge on the books, so she may be charged with forcible rape of a child.
I'm not defending her, but in my mind "forcible rape of a child" is just that and not consentual sex with a teenager.
Opinions?

I think she's being railroaded but they have Mary Laterno as precedent. She's gonna do time but forcible rape. Hardly.
I suspect that's the only charge they could come up with. Without that charge she probably walks.

I've never been a 14 year old boy, but having raised one, I'm under the impression that the offer of sex completely negates the idea of it being "forced". Gentlemen, help me out with that one, please.
IIRC, didn't Mary Laterno claim she was "in love" with her student? (She's the one who got pregnant, right?) From what I've read, and from what I heard (and it all has to be true because it was on the internet and radio), she seemed to be in it just for sex.
One of the things being debated is what would happen if the teacher were male and the student female.
I think she was wrong. I think she should never teach again and I think she needs some heavy duty mental health work, but I don't think the world would be a safer place with her in prison for life.

Boys are just as open to being victimized sexually as girls. They are sexually immature and are just as able to be vicitimized by an adult as girls.
If you believe that sexual relations between and adult and a 14 year old girl is rape then you should also see relations between an adult woman and a 14 year old boy as the same.

As I remember, falling in love was just as easy for a young male as it was for a young woman. The overt displays associated with the sexual and emotional infatuations were different due to social pressure to conform to then accepted stereotypes for the sexes but the underlying urges, again both physical and emotional, seemed to be pretty much the same.
We have been moving away from the traditional viewpoints that men and women are so terribly different with regards to sex and while I do believe that there are inherent differences I do not believe that they are either as extreme nor as clear cut as they have been portrayed in the past.
The applicable language is as follows:
n4 Section 800.04 entitled "Lewd, lascivious, or indecent assault or act upon or in the presence of child," provides:
A person who:
(1) Handles, fondles, or assaults any child under the age of 16 years in a lewd, lascivious, or indecent manner;
(2) Commits actual or simulated sexual intercourse, deviate sexual intercourse, sexual bestiality, masturbation, sadomasochistic abuse, actual lewd exhibition of the genitals, or any act or conduct which simulates that sexual battery is being or will be committed upon any child under the age of 16 years or forces or entices the child to commit any such act;
(3) Commits an act defined as sexual battery under s. 794.011(1)(h) upon any child under the age of 16 years; or
(4) Knowingly commits any lewd or lascivious act in the presence of any child under the age of 16 years, without committing the crime of sexual battery, commits a felony of the second degree . . . .
I didn't look to see what punishments ensue from their various felonious degrees. But, suffice to say, she's probably not in as much trouble as the media indicates.
And Pina, while I agree with you 100% in theory, the reality of the situation is you're going to be hard-pressed to get a conviction if you can't show some type of unwelcome or forced contact (or, say for example, if the adult woman injures the minor male). Most guys on the jury are going to think like Jumper, i.e. where was this chick when they were in grade school?
In time, things may level out, but for now, it's a difficult case to prove.

You can elicit a sexual response from an unwilling male. Stress may make it more difficult but the plumbing will respond given the correct stimulation.
You might also want to consider that traditional male/female fornication is not the only act that a woman can perform on a male. So many orifices, so little time if you will.
