If they didn't, and taking Nintendo to court would be one hell of a mountain to climb, the case of copyright infringement could be worth a tidy sum!! Especially seeing as the advertisment is not showing them in a particularly flattering fashion.
I remember Blackie Lawless doing a similar thing when Tipper Gore was using the "Animal" single cover for use in her campaign. He won!
Could be interesting to see if anything happens!
