Ok, this is the prime example of police bullshit!
After I got out of a night class I just started to attend, I decided to meet up with some friends at Jack in the Box. After we were their for a while we decided to go over the Blue Rock Shoot (some Saratoga coffee shop in the downtown. Very nice/rich area!) Anyway, at this time it was around 10:45. On our way their my friend James called me (has a 00 ITR), and asked where I was going cause he just saw me drive by. I told him to come over and meet us their. Anyway to make this long story short, around 11:15 we decided to leave, and go home. Just as I was about to start my car to leave, two cop cars came flying in trapping me in my spot! I opened the door, and the cops yelled for me to get the FUC* out of the car, and put my hands on the roof! So I did. They grabbed me, and searched me. They asked what I know about racing in residential areas around here(Swearing every other word). I said I have no idea what their talking about. They said kids racing around here, are known to do Meth, Crank, Acid, Pot, etc..., and asked what drugs I'm on! I said um, I have no idea about kids doing doing drugs back here, and that I don't do drugs! They asked why I was racing around here. I said I wasn't, and that I just got here. They asked why I was lying to them, and if I think they are fu**ing stupid! I said I wasn't lying to them, and I have no idea what they are talking about. (At this time everyone in the area is gone, except me, and the cops. The officers ran me around in circles forever trying to make me confess to night racing. They made me address them as yes officer, no officer, etc... After awhile the officers started to get really pissed since I wouldn't confess to this suspossed crime. They hand cuffed me, and threw me in the back of their car. At this time I was really worried. The cops came back, and told me to tell them I was racing, and that they have a witness! They said if I confess to the crime, the witness(which I couldn't see) would not press charges, and I would be set free! I said, but I wasn't racing, and this "witness" was lying! This time, they threw me out of the car, and asked if I would like to get ass raped in jail, cause if I don't admit to racing, I was going to be sent to jail. I said this is bullshit, and I wasn't racing, and I have no idea what their talking about! After I said that, they finger printed me, and started writing up the arrest report! (At this time I had no idea what the cops were going to make up, so I decided I need to get someone's attention from outside!) So as I was handcuffed in the back seat, I set off my panic on my car alarm (since my keys were in my pocket next to my hands. After about a min, some people came by from the local hotel next door to see whats going on. Once the cops saw the people watching, they told me to never race again, and said if they ever see me around here, I would be screwed! So they let me go, and told me that, I am now being red flagged from suspicion of racing, and that I will here from the DMV if they decide to give me a drivers evaluation! Anyway, I finally got home around 1:30am, and I never got anything from the cops. No even their names! WTF!!!!!!!!!!!

Actually if you are totally serious, you can get a lawyer and find out who those cops were. They check in with the department everytime they stop someone so they'll be able to track down who it was. I'm not sure how easy it will be to fight this in court though as you have no witnesses. Do you have any bruises or marks? If so, take pictures now. Had they said literally what you posted, they broke several laws. Sorry to hear about that incident but that's how life goes around here in riceland. They hate ricers and want to get rid of them so guys like us get thrown into that stereotype when we own a souped up Acura. I guess that's part of the advantage of switching to the Camaro as I don't worry about the cops much anymore unless I'm going to get caught racing or speed way beyond the limit.

Holy shit, that sounds like a nightmare. Reminds me of a similar incident when I was walking to a parking garage downtown and got harrased. Same exact deal with the cops trying to get me to confess to something. They patted me down and kept asking me if I wanted to go to jail that night (like someone would say yes). They kept threatening to "take me in" and told me to stop lying. I was in an area were people were occasionaly passing by and looking so they couldn't get too nasty. I guess in the end I was just in the wrong place at the wrong time. It felt like I was in one of those episodes of COPS. Anyway, I can laugh about it now but your situation definitly sounded worse. Hopefully that red flag crap is a bunch of bs and nothing will come from it.

I have nothing from them. It was soo dark it would be almost inpossable to get it. Also I just wanted to get the hell out of their! God knows what they would to me if I stayed. I only have some red marks from the handcuffs. I will post a picture it later today, if they are still here. What BS! But whats really a twist is they said the "witness" had my plate, and called 911 with it! Thats why they came!
I dunno, if I get something in the mail from the DMV, or when I call the DMV, and they show something on my record for this, I will go nuts! If nothing shows up, then forget it. I dont have the time, or effort. I'd rather work on my car! http://www.hostboard.com/ubb/smile.gif

Sorry you had that happen. I'm not a bit surprised that they lied to you and tried to intimidate you into confessing by lieing some more. It happened to me when I was young and stupid enough to give in and confess. My case was thrown out because of this illegal interogation.
You will probably never get any satisfaction out of pursueing official redress. It sounds like you have the best attitude possible now. Don't waste your energy on them. Without witnesses you are powerless.
Now that the local police hate you and will pull you over for anything, you may as well express you're 1st amendment rights by putting "F*** THE POLICE" and other anti-police slogans on your car. It can't hurt you now.

Lol thats funny! Yeah well once the end of Sept comes, I will be driving a truck, and leaving the R at home. I will make sure not to drive anywhere in that area for the next couple of months. I just think it sucks that I have no info about what they wrote up. Maybe on Fri, I will go the the police station, and ask to see a copy of the report, or find out what I was finger printed for. I just think it sucks to get blamed for such a BS thing.

Just a note to everyone on your rights.
When detained by the police, YOU DO NOT HAVE TO TELL THEM ANYTHING!!!!
Obviously, give them your name and address, but beyond that, there is nothing you can do for yourself by saying anything. Especially if the police are already hostile.
Here's a good line I have memorized:
"If you have enough evidence to arrest me, then go ahead and do it. Otherwise let me go now. Either way, I will not answer any questions without my lawyer present."
The cops don't care what they bust you on. If they can scare you into confessing to something, anything, they consider it a win.
That statement could have saved me $1000 in legal fees if I'd known it 11 years ago.

I'd go and report this incident right away. If you're being arrested, they will read you your rights immediately. It sounds like a totally illegal interrogation.
As for the witness part, maybe the cops were not lying about that part. Let's use this hypothetical situation:
You go to the coffee shop at 10:45. Did you drive their with other friends driving too? At any point did you floor it, rev, etc? From my experience, in nice, rich areas, the people tend to report a lot of stupid ass things. So, even if you were just driving along, a homeowner nearby might have heard a modified exhaust (if you or your friend has one) and thought it was people racing. The witness saw your car, assumed (from the loud exhaust) you were racing. The person reports it to the cops...30 min. later you're leaving and the cops spot your car.
This is the typical life of a rice rocket owner. Sucks big time, but look at where it's all coming from... Just on the news last night, I heard that a passenger in a modified Accord died while racing another car (a Civic?). We'll lose the stereotypes when all these dumbasses stop street racing.
Sure, you may not street race...but I'm sure there are a hell of a lot of us here on this board that do. Hence, the negative stereotypes, attitudes, etc towards rice rockets.

The whole time the cops just harrassed me, trying to get me to say something. I wounldn't! Thats why they arrested me, etc...
Even if they did have a "witness" that called 911 and gave them my plate, they still have nothing. The cops have to be present in the act of the crime. Hell if they did bust me for this, then I could go home call 911 give them a plate of a car speeding around by my house, and press charges. What BS. The cops told me the only reason they didn't arrest me was because the witness didn't press charges. Yeah OK!

Perfect!!!! Thats exactly what I think happened! My friend that was their drove a CRX with a LS engine, and straight pipes. Since leaving their you are required to drive up a huge hill, he floored it. maybe the witness did hear it, and saw my car in the parking lot, and said it was me! Wow! I think I will say something about this! Thanks for the new insight! Also any stuff the cops could use against me? (BTW I have a clean record. Jst went to traffic school to clear a speeding ticket around that same area! And worst of all that cop too was a asshole, and lied about my speed! I do admit to speeding then. Maybe 5-10over on a 45mph road. But not 85mph!!!!

That had to suck wank. I usually try to avoid Saratoga when I'm driving my Integra. I've had nothing but glares by cops when I'm there in that car. It's annoying too since I have to go through there to get to one of the movie theaters that I like.
As fucked up as it seems, the most reasonable cops that I've ever had to deal with have been CHP officers. Local cops, especially from rich neighborhoods, are the biggest assholes I've had to deal with.
If you decide to follow up with a complaint to the police department I hope you get somebody in trouble.

They never got me to admit to saying I raced. They never read me my rights because I was never taken in. They said the "witness" saw me drive by his house twice. Which also make no sence still. See Saratoga is the type of city where the residents complain about everything. Including street lights! Yes thats right. Saratoga has no street lights. So if this witness saw me drive by twice, he would have to read my plate going by in a unlighted street. Not to mention getting blinded my be new HID's http://www.hostboard.com/ubb/smile.gif So this did happen, it would be almost impossable. Personally all I want is my record to show this never happended, and for the cops to get a lesson on police burtality. See I'm only 19yrs old. For me to go to court, and battle them would be a joke. There is now way a judge or anyone to listen to me. On Fri, I plan to go down to the police station, and get a report of the event, including officers name, and badge numbers. Why you ask? Well if I ever get pulled over again by them, I have some thing to hold up in court. See the cops told me that they will be looking for me, and they were not to happy about letting me go. So I think a judge might see a biased view from the officer. Are cops allowed to put you in their car with out reading your rights? Cause it is holding you agaist your will. Also aren't they suspossed to give you a copy of all the info taken?

Damn Mike, not to make it sound like African Americans are the only ones, but are you black? I used to get shit like that happening all the time to me. But just so you guys know, what Holden said is the best thing you can do. Say nothing! But police can interrigate and physically detain a criminal suspect with out giving Miranda warnings as long as the suspect is not in "Custody". Generally a time limit of 20 minutes or however long might take to remove the suspesion of criminality from the suspect (this is so that if a cop has to wait to get more info or something from another officer or witness the time is not as critical) It's called a "Terry stop" after a court case in Ohio where the suspects were detained for 40 minutes while contraband was seized yet they were questioned the whold time and never put "Under arrest". That really sucks that shit like this happens all over the country but the best thing to do is keep your cool and above all, don't mouth off to officers.

Lol! I'm white as day. And no not the cocky smart ass white kid look either. But are the cops allowed to hold you from 11:15pm to 12:45am? That seems kinda long. Also the fact of threating me, that if I don't teel them the truth that I was racing, I would be sent to jail, and as the officers put it, "ass raped". They also said if the witness wanted to press charges on me, I would be sent to jail. Is this true, or BS. To my knowlage I thought the police had to witness the act of racing.

I guess the cops are real pricks around there huh? Well the whole detention thing is kinda like arrelavant because nothing was discovered (illegal substances or stuff liek that) while they were holding you. They did keep you for a long assed time though but they could say they were trying to contact the witness. I am n0t 100% sure but I pretty sure that the cops have to personallty see you racing to give you a ticket and they had to see you at the scene of the crime. No after the fact aressts at the Village Inn (breakfast place here in Nebraska). The language and intimidation is an age old technique that can be used and is hard to prove in court, "He said I'd get ass raped if I did tell him something" would very easily be diregarded especially with it being your word against his. About the witness, they have no proof either and you didn't physically do anything to them so they couldn't do shit. Don't say a word is the best thing to do. You are only legally responsible to truthfully identify yourself.

I think the smartest thing you could do is go to the police headquarters and tell someone in command about this situation. Whether or not anything comes of it, there will be a record that you came in to talk to someone there. (Make sure they record the complaint)
The absolute worst thing you could do is not do anything about it. The reason why cops do this sh*t in the first place is because no one does anything when it does happen.

Not true They dont have to read you your rights at all its a common misconception. Your rights are read to you only when you are interogated by an Investigator. A regular beat cop doesnt interogate shit. He can give you a stern talking to. but if he starts asking you questions trying to get you to confess he is wrong. If he feels you did something wrong he can take you to jail and then and investogator will take over from there. Your little run in sounds like police harassment to me also. You can get them into alot of shit, for doing that. everything you discribed is not close to procedure. I dont really know where you are from but i dont know any agency who finger prints on Site. thats bull shit. if they did that they were just intimidating you. making you think they were going to jail. Get a lawyer and fight this shit.
btw I started my 3rd year of studing criminal justice and police procedure today. so i have some idea what is supposed to go on and not supposed to go on. I also ride with the police every so often to see what really goes down.

True they wont listen to you trust me! but they will however listen to your lawyer. Update to the story. Well I finally got the police officers names, and police report info. According to the report, I was racing up and down the streets around 11:15. (kinda impossable since the cops were their around 11:15. Some resident saw me racing, and figured I was hanging out at the coffee shop. He suspossidly came over, and got in a yelling fight with me. According to the report, I then taunted him with my car by revving it, and acting like I was going to run over him!!!! (yeah me in my 4cly R, lowered to the ground trying to run over someone!!!) Anyways, the report said he called to cops, and wanted to put me under citizens arrest! But then decided to back down!!
I will try to get a copy of the report ASAP, and post a scan of it. I will also be pressing charges on all parties involed in this BS harrasment/slander/defimation of character/unlawfull arrest/etc...case. I will be meeting with the highest officals in the city ASAP, and I have about 10+ witness on my side proving that I never raced anyone, that I never even encountered the "witness", that I never even yelled/taunted/etc... anyone. I will be also contacting lawers for info. If anyone has any advice, please tell me now!
BTW I just meet two people from this list (A-dub5513, and nexusone) You can ask them if I appear to be the punk kid that drives around harrasing/racing people! LoL

Yeah, I have the internal affairs number. I also have a contact with the ACLU, and the Watch Dog Police Task Force. If you have a contact out here in CA (Bay area) please let know! I will post some more info as it comes. I also have a 50 page report of the "Citizens Arrest" penal code. According to this one list, "Even with such a statute, the citizen still risks being sued if he/she is wrong on his assessment of the situation. Notice that the statute requires that the "public offense" be in the citizen's presence, or that the person arrested have committed a "felony," that is, a crime punishable by one year or more in state prison. Do you know which crimes are punishable by one or more years in state prison? Can you be absolutely sure the person you are arresting is the one who committed the offense? What if there were three people involved? Can you be sure which one is the one you should arrest? At the very least, a defense lawyer is going to argue that the requirements for citizen's arrest were not met and that the arrest, and any consequent seizure of contraband, were illegal." ---Hmmm since when is street racing a crime punishable by one or more yrs in a state prison? Do I smell BS???? Can anyone here count how many crimes I have against them? LoL

A little advice. You are not trying to prove that you were not racing. You should simply file a law suit for abuse. Get a lawyer, or go talk to one.
