I was thinking the same thing. No way a restaraunt is responsible for you going out and killing someone. I know several people who until they get up and walk away from a bar, you have no clue they are even drunk. Different people have different alcohol tolerance and as busy as most bartenders are, they should not be responsible for each and every person walking in or out of the bar.

If the people up front notice you can't walk or fall into people or boothes, then they should stop you and ask if you have a ride or if you need a cab. But, I don't see how an establishment could be responsible for sometimes hundreds of people who come in and out of the bar. What if they only had 1 beer at the bar but maybe had 15 somewhere else, are they going to cut you off after 1, no way. To many different situations or circumstances could evolve from the time you enter that building. Each person needs to be responsible for themselves and their actions, sober or not.

I have known Applebee's to cut people off. If they think you have drank to much and haven't eaten, they will ask you to order some food or leave.

Yeah, I've seen Applebee's do that to people as well.

after continuous shots of liquor and beers, a bartender can, and should cut you off.
I've read some cases, where in fact, it has come back against the establishment for serving someone too much.
yes, everyone should be in charge of their own actions and such, but when you aren't in the right state of mind, and someone doesn't help out the situation just to make a few more bucks, then it is their responsibility to stop you.

I can see both sides of it I guess, but ultimately it has to be up to the individual to know his or her tolerance. Some people can drink 20 beers and it doesn't phase them, some can only drink 3. Is the bartender supposed to ask you when you order what your tolerance is so he can babysit you. I don't think so.

Also, I don't think I could feel good about myself blaming an establishment because I couldn't control myself on a wild and crazy night. That's just me, some people may feel different about the situation. That is not a shot at you V or D or anyone in general, just my opinion if I was put in that situation.

If your old enough to drink, your old enough to know when to quit. I don't see how it's the bar responsibility to decide when you are ok. If I go by 2 cases of Bud and down it all in one night and then go get in my car, wreck, and kill someone is FastMart responsible for selling me two cases at once? Or is Budweiser?

Exactly, you are old enough to know when to quit. But you sit down at a bar, and the bartender knows you've had lets say 5 shots of a hard dark liquor, and then a couple beers, and a few more "for the road" shots.. and doesn't say "can I get you a cab?", or "I don't think you should be driving", and lets you walk out that door, knowing you are that bad.. then yes, they are at fault, and can be prosecuted.

So if the person is underage, and they are buying alcohol at a bar, and the bartender is aware of their age.. they leave and are drunk, and wreck, and kill someone.. who's fault is it? I mean they are old enough to know what they are doing is wrong and not legal, but yet they do it anyway.. the bartender knows the same.

This is why these establishments that sell alcohol have to purchase liquor liability insurance. To some degree they are responsible for what happens to those that purchase it - or those they might harm.

It's just the litigious society we live in - I dont necessarily agree with it - but unfortunately it's just how it is.

thats why I thought they would have insurance for their products in the store, incase an "accident" happens.. insurance should cover a piece of plywood/pasteboard on a booth.
I have no problem paying for it... but I'm just not wanting to get ripped off. Accidents happen, and all.. drunk or not, you shouldn't rip someone off, especially someone that spends a fortune in that establishment.
