It may be a problem if someone other than the mother has legal custody and she has no legal custody rights. But it would be up to the parents to provide the proof and VHSL to verify this.
Essentially someone has to have actual custody of him in order to be eligible in a transfer situation.

In fact that is what I am saying, the mother never legally gave up her rights to the court per say. Her and her mother jsut had an agreement that at that time it may be best for her kids if they were to stay with the grandmother. I personally know the grandmother and she is a good lady, tough, but a good lady that only desires the best for him. So legally the mother never gave up nor lost custody.
So if that is the case, then the grandmother doesn't have legal custody then the other Pinkston, if living with grandmother who isn't legal guardian is inelegable, correct? Because he doesn't live with the person who has legal custody. So PV would have to forfeit many games. This is too much for my little brain to process.
This could stir up some contraversy in the LPD, if true.

Doesn't he have to live with his legal guardian to be eligable, that is what everybody has been screaming for the last 3 days. That you have to live with the one who has legal custody of you to be eligable. Maybe I am missing something. If it isn't a big deal for the other to live with his grandmother who doesn't have legal custody of him then why would it be a problem for Malcolm to just live with anybody. That is my point.
A verbal agreement between mother and daughter doesn't hold weight in a legal process, it has to go through the courts.

It's not illegal to live with someone who isn't your legal guardian. It IS illegal to live with someone who isn't a legal guardian appointed by a court and play sports for a school outside the school district your legal guardian resides in per VHSL rules. So if the grandmother isn't the legal guardian and the mother is still considered his guardian it is illegal to play ANYWHERE but where his mother lives. </div></div>

That doesn't apply to anything but the transfer rule. It doesn't matter who or where you live when you first enter the 9th grade. You don't even have to have passed the 8th grade, as you could have been place in the 9th grade. The point is....once you first enter the 9th grade, you are automatically eligible regardless of any circumstances. But once you establish that eligibility, you have to follow strict rules to change in to another school.

But, considering he has lived with his grandmother for years and now decides to go live with his mother they do have a fight against the VHSL ruling because that is his legal guardian. In doing that that would not make the other brother not able to play since he has been established since the 9th grade.
